Cancellation & Refund Policy

Introduction

This Cancellation & Refund Policy ("Policy") governs the cancellation and refund procedures for services provided by NOVOBLOC TECHNOLOGIES PRIVATE LIMITED ("Novobloc", "we", "us", or "our"). By engaging our services, you ("Client", "you", or "your") agree to the terms outlined in this Policy.

This Policy applies to all services provided by Novobloc, including but not limited to web development, mobile app development, UI/UX design, consulting services, and maintenance services.

Cancellation Policy

Client-Initiated Cancellation

Clients may cancel a project or service at any time by providing written notice to Novobloc. The cancellation will be effective upon receipt of the written notice.

Cancellation Fees

Cancellation fees will be determined based on the stage of the project and work completed:

  • Before Project Commencement: No cancellation fee if no work has been initiated. Any advance payment will be refunded minus any administrative charges (if applicable).
  • During Development Phase (0-25% completion): 25% of the total project cost or actual work completed, whichever is higher.
  • During Development Phase (26-50% completion): 50% of the total project cost or actual work completed, whichever is higher.
  • During Development Phase (51-75% completion): 75% of the total project cost or actual work completed, whichever is higher.
  • After 75% Completion: Full project cost is payable. No refund will be provided, but deliverables completed up to the cancellation date will be provided to the client.

Novobloc-Initiated Cancellation

Novobloc reserves the right to cancel a project in the following circumstances:

  • Non-payment of invoices after due date
  • Breach of contract terms by the client
  • Unreasonable demands or scope changes that violate the original agreement
  • Client's failure to provide necessary information or resources
  • Any illegal or unethical activities related to the project

In case of cancellation by Novobloc due to client's breach, no refund will be provided for work completed, and Novobloc may seek compensation for damages incurred.

Refund Policy

Eligibility for Refund

Refunds may be considered under the following circumstances:

  • Project cancellation before any work has commenced (minus any administrative charges)
  • Failure by Novobloc to deliver services as per the agreed terms and conditions
  • Technical issues or errors that cannot be resolved within a reasonable timeframe
  • Mutual agreement between Novobloc and the client for project termination

Non-Refundable Items

The following are non-refundable:

  • Work completed and delivered to the client
  • Third-party services, licenses, or subscriptions purchased on behalf of the client
  • Administrative and processing fees (if applicable)
  • Consulting hours already utilized
  • Projects cancelled after 75% completion

Refund Processing

If a refund is approved:

  • Refunds will be processed within 15-30 business days from the date of approval
  • Refunds will be issued to the original payment method used for the transaction
  • Bank transfer fees (if applicable) may be deducted from the refund amount
  • For international clients, refunds will be processed in the original currency, subject to exchange rate fluctuations

Time & Material Projects

For projects billed on a time and material basis:

  • Clients are billed only for actual hours worked and materials used
  • Cancellation can be done at any time with 7 days written notice
  • Payment is due for all work completed up to the cancellation date
  • No refund will be provided for hours already worked and billed

Dedicated Team Arrangements

For dedicated team arrangements:

  • Minimum commitment period applies as per the agreement (typically 3-6 months)
  • Early termination may incur penalties as specified in the service agreement
  • Notice period of 30 days is required for termination
  • Payment is due for the notice period even if services are not fully utilized

Maintenance & Support Services

For ongoing maintenance and support services:

  • Monthly/annual subscriptions can be cancelled with 30 days written notice
  • No refund for the current billing period
  • Services will continue until the end of the current billing period
  • One-time support tickets are non-refundable once work has commenced

Dispute Resolution

In case of any disputes regarding cancellation or refund:

  • Clients should contact us at hello@novobloc.in with detailed information about the dispute
  • We will review the case and respond within 5-7 business days
  • If the dispute cannot be resolved amicably, it will be subject to the jurisdiction of courts in Bengaluru, Karnataka, India
  • Both parties agree to attempt mediation before pursuing legal action

Changes to This Policy

Novobloc reserves the right to modify this Cancellation & Refund Policy at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Policy.

For existing projects, the Policy in effect at the time of project initiation will apply unless both parties agree to adopt the updated Policy.
